Please read these terms carefully. You have enrolled in the FoamWorks Unlimited Club. Enrollment means you accept and agree to all these terms, including our website Terms and Conditions of Use and Privacy Policy. If you have enrolled by mistake, please contact us via www.foamworkscarwash.com/manage-my-plan for assistance in terminating your subscription.  

All Unlimited Club packages and plans are a monthly automatic subscription. This means that the credit/debit card on file will be charged every month for the amount you agreed to when you signed up in person or at an in-store kiosk. This monthly charge will be billed every month on or around the anniversary of your enrollment date.

Unlimited Club membership is an automatic recurring program that will remain in effect until you log into the customer portal at www.foamworkscarwash.com/manage-my-plan and cancel your membership. Cancellations require a 7 business day notice prior to processing date. No refunds or credits will be given for partial periods (such as mid-month cancellations), days the wash is unavailable (such as for inclement weather or maintenance), or for billing cycles with no wash usage. FoamWorks may terminate plan immediately if the charge is declined in the payment card processing system.

Monthly rate may increase at any time without prior notice from FoamWorks. This program cannot be combined with any other offers or discounts. 

Unlimited Club passes are good for one vehicle only and must remain securely adhered to the windshield on the driver’s side. Vehicle must meet FoamWorks safety guidelines. Our acceptance of your enrollment does not guarantee that these guidelines have been satisfied.

FoamWorks reserves the right to terminate accounts at any time for abuse and/or safety concerns. When flagged for abuse or safety, termination may take place with or without notice.

FoamWorks reserves the right to modify or cancel this program and the membership at any time. FoamWorks reserves the right to close locations or suspend services due to inclement weather, holidays, equipment maintenance, and

Cash or FoamWorks Gift Cards cannot be accepted for automatic subscription plans.

All services are provided AS-IS and you use them at your risk. WE MAKE NO WARRANTIES WHATSOEVER WITH RESPECT TO THE UNLIMITED CLUB OR ANY OTHER SERVICES OFFERED ON OR IN CONNECTION WITH THIS SITE. ALL WARRANTIES WITH RESPECT TO ALL SERVICES, EXPRESS AND IMPLIED, ARE EXPRESSLY DISCLAIMED. YOU AFFIRM THAT WE SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES, FOR ANY BREACH OF WARRANTY CLAIMS OR ANY DAMAGES RELATING TO SUCH CLAIMS.

IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGES, LOST PROFITS OR REVENUES OR DIMINUTION IN VALUE, ARISING OUT OF, OR RELATING TO, AND/OR IN CONNECTION WITH ANY BREACH OF THESE TERMS, REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE, (B) WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT, OR OTHERWISE) UPON WHICH THE CLAIM IS BASED.

TO THE MAXIMUM EXTENT ALLOWED BY LAW: OUR SOLE AND ENTIRE MAXIMUM LIABILITY, FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE PRODUCTS AND SERVICES YOU HAVE ORDERED THROUGH OUR SITE...  

These terms and all matters arising from or relating to them are governed by the laws of the state of Georgia, without regard to its conflicts of law principles. If any provision of these terms is invalid, illegal, void, or unenforceable, then that provision will be deemed severed from these terms and will not affect the validity or enforceability of the remaining provisions of these terms. These terms, our Website Terms and Conditions of Use, and our Privacy Policy will be deemed the final and integrated agreement between you and us on the matters contained in these terms. You will not assign any of your rights or delegate any of your obligations under these terms without our prior written consent. Any purported assignment or delegation is null and void. The failure by us to enforce any right or provision of these terms will not constitute a waiver of future enforcement of that right or provision.
